RULES AND REGULATIONS OF BETH EL CONGREGATION MEMORIAL PARK


1. Interment in Beth El Congregation Memorial Park ("Memorial Park") is restricted to members of the Jewish faith, except in such sections of the Memorial Park as shall from time to time be designated by the Board of Directors of the Memorial Park in which burial will be permitted for the following relatives of a member: (i) his/her spouse, even if a non-Jew; (ii) his/her children and their spouses even if non-Jewish; (iii) his/her grandchildren, even in non-Jewish; (iv) his/her siblings (and their spouses), even if non-Jewish; (v) his/her parents, even if non-Jewish. The aforesaid privileges intended on the basis of membership shall apply both during and after members' lifetime. Upon refusal of the Memorial Park to permit interment because of this rule, as then amended or modified, the Memorial Park may refund to the Owner the original purchase price, and the liability of the Memorial Park shall be limited to said amount, when shall be the sole and only remedy of Owner. Upon the refund of this amount, all interest of owner in any said lot(s) shall revert to the Memorial Park and said Owner and/or his representations shall do all acts necessary to reconvey the lot(s) to the Memorial Park.


2. No enclosure, fence, coping, tree, shrub, planting, adornments, or other additions shall be permitted in, on or around any grave or lot. The size, wording and materials of grave monuments, footstones, etc. shall be regulated by Beth El Congregation Memorial Park.


This is done to conform to the historic and cherished Jewish teaching that every person before God is the equal of every other person, that a cemetery should not be a place to reflect distinctions between people that in life were based upon personal accomplishment or even the special feelings of a family to their beloved. Such things are for the living to share in their own lives. Therefore, the recommended wording of all plaques at the Beth El Congregation Memorial Park shall read (according to each person involved), after the name of the departed and the date of passing has been noted,


                                        'Beloved husband, father, grandfather, great-grandfather,

                                   brother, sister, son, daughter, friend or any other significant relationship

                                      deemed appropriate to honor the memory of the deceased.'


Wording is limited to thirty-four characters per line subject to a maximum of six lines. All such wording must be approved by the Memorial Park Committee and an additional charge to the owner will be incurred.


3. Inasmuch as interment in a Jewish cemetery is a religious ceremony, the right of officiation within the Memorial park is restricted to ordained clergy of the Jewish faith or other members of the Jewish faith approved by the Rabbi of Beth El Congregation.



4. Vault liners shall be used for all interments to preserve the structural stability of each grave site.


5. The Memorial Park grounds shall be open for visitation from 9 A.M. until 5 P.M. daily, but shall be closed to visitation on the Sabbath and Jewish holidays.


6. Solicitation of any kind is prohibited on the Memorial Park grounds, including charitable appeals and the offering of memorial prayers by uninvited persons.


7. No disinterment from any plot or grave shall be made without prior written consent of the owners of the plot and of all persons having an interest therein including Beth El Congregation Memorial Park, or upon an order of a court or competent jurisdiction. All charges for such disinterment shall be payable in advance before disinterment shall be permitted.


8. Unveilings shall be scheduled through the office of Beth El Congregation and may not be held on the Sabbath or Jewish Holidays.


9. The final authority on matters of religious law (Halachah) in regard to the Memorial Park shall be the Rabbi of Beth El Congregation.


10. Perpetual care is restricted to maintenance and upkeep of the lot only and does not include foundations or monuments.


11. No burials can be permitted in any lot, until the full purchase price has been paid by the purchaser.


12. Plot owners shall not sell, transfer or assign any lot, or any interest in it without the consent in writing of the Congregational President or Vice President, and such information shall be endorsed upon such transfer or assignment. If purchaser desires to transfer said lot, it shall first be offered to the congregation for it to buy at the same price which was paid for the lot in question.
