Cemetery Board meets semi-annually on the 3rd Monday of February and the 3rd Monday of August and other dates as necessary. Meetings generally are held at the Osage County Abstract Office, 206 E. Main, Linn, MO 65051
The following rules and regulations have been adopted as a guide to use in management of the Linn Public Cemetery. The rules and regulations will help to protect all who have interest here. All lot owners, visitors and contractors preforming work within the cemetery grounds shall be subject to the following rules, regulations and amendments or alterations as shall be adopted by the board from time to time.
Definitions
Linn Public Cemetery Association Board is a volunteer group of people who make the rules and regulations for the cemetery.
Grave Lot is a single designated interment space in the cemetery that shall be used for burial of human remains.
Monument is an upright or flat marker, generally made from stone or metal alloy used to identify a grave or graves.
Owner is the person or persons to whom the Linn Public Cemetery Association Board has conveyed a burial right or rights or a person or persons who hold such burial right or rights by inheritance or a person or persons who have acquired such rights by proof of written consent from transfer.
Outside Container is a container that houses the casket in the ground. Commonly referred to as a vault or grave box. Usually made out of concrete or steel.
Casket is a container that houses the body for burial, usually made out of steel or wood.
Urn is a container used for cremated remains.
General Rules and Regulations
1. Rules and regulations for the cemetery, as well as pricing of grave lots, will be made by the Linn Public Cemetery Association Board and become effective upon approval from a quorum of members.
2. The Linn Public Cemetery Association Board may, at any time, with or without notice to lot owners, adopt new rules and regulations or alter any rule or regulation in effect. The board may also, at any time, change fee that are charged for new grave lots purchases.
3. The Linn Public Cemetery Association Board retains full and complete supervision, control and management of the land, roads, walks, utilities, developments, books and records for the Linn Public Cemetery.
4. Grave lots must be paid for in full before a burial takes place. The present rate for a single grave space in the Linn Public Cemetery is $350.
5. The Linn Public Cemetery is not designated as a perpetual care cemetery. The upkeep of the grave lot(s) is the sole responsibility of the grave lot owner or the next of kin of the grave lot owner. This includes but is not limited to, leveling, filling and seeding of the grave lot after a burial. The Linn Public Cemetery Association Board however will provide for the general upkeep of the cemetery including but not limited to mowing, weed eating, blowing off of grave-sites after mowing as well as flower/decoration removal as stated in rule # 15.
6. The Linn Public Cemetery Association Board will issue a “Certificate of Ownership” document to each owner of a grave lot(s). Documentation will provide burial Section name, Row number and Grave number. Grave lots may be prepurchased for future use.
7. No person, other than employees or outside contractors preforming their duties shall be allowed to perform any work within the cemetery without permission from the Linn Public Cemetery Association Board. Exception being the responsibility of the grave lot owner as stated in rule #5.
8. The Linn Public Cemetery Association Board will take all reasonable precautions to protect lot owner’s and visitor’s within the cemetery from loss, damage or injury but it shall not be responsible for any loss, damage or injury.
9. Bringing alcohol or illegal drugs onto cemetery grounds is strictly prohibited.
10. The Linn Public Cemetery Association Board shall have the right to enter upon or use any adjoining lot or lots to carry out its duties to interments, erection of monuments or markers, trimming or removing any tree or shrub, etc.
11. Interments into a grave lot are restricted to those entitled to burial therein according to these rules and regulations.
12. The use of one grave lot shall be limited to interments as follows unless otherwise permitted by the cemetery board:
13. No disinterment will be allowed without permission of the next of kin, the Linn Public Cemetery Association Board, and the proper authorities. Any damage occurring during an authorized disinterment will not be the responsibility of the cemetery.
14. The cemetery shall in no way be liable for any container (casket, outside container or urn/urn vault) or monument or grave marker placed in or on any grave lot. The scattering of cremated remains over or on a grave lot is prohibited.
15. The Linn Public Cemetery Association Board reserves the right to remove all flowers, wreaths or other decorations from grave lots as soon as they become unsightly in the boards opinion. This however does not pertain to flowers or decorations that are attached to a permanent grave marker or monument including flowers in vases that are attached to a permanent grave marker or monument. The cemetery grounds will be cleared of decorations twice per year. Spring cleanup will begin March 1 and fall cleanup will begin October 1. In order for a family to save any decorations placed on a grave, the decoration should be picked up prior to these dates.
16. Items not allowed to be placed on a grave lot within the cemetery include but are not limited to, curbing of any kind, decorative rocks, fencing, hedging, borders, enclosures or any type of benches permanent or otherwise, without the consent of the Linn Public Cemetery Association Board.
17. The Linn Public Cemetery Association Board shall have the right to remove all objects whose appearance and condition warrant removal and/or violate the cemeteries rules and regulations. The Linn Public Cemetery Association Board also will not be held liable for any flower or decorations removed or lost by any cause.
18. The Linn Public Cemetery Association Board shall have the right to reject any marker, memorial or monument that, on account of its size, type, design, inscription, quality, color or method of construction is unsuitable for the particular grave lot on which it has been placed. The Linn Public Cemetery Association Board reserves the right to prevent the placing or to remove any marker or other objects that do not comply with the standards of the cemetery. Also the cemetery requires that the purchase of any and all markers/monuments must be from an approved monument dealer or agent.
19. Cemetery lots can be marked with a maximum of three (3) permanent markers/monuments. One shall be placed at the head of the grave lot and one may be place in the middle of the grave lot and the third can be placed at the foot of the grave lot. The marker located at the head of the grave can be one of the following:
The marker/monument placed in the middle or at the foot of the grave is required to be of a flat design only. Meaning, when installed the marker is level to the ground so as to be able to mow over the top.
20. All grave-sites require a permanent marker/monument to be in place within 12 months of the burial.
21. The Linn Public Cemetery Association maintains the right to remove or trim any tree or shrub situated on any grave lot that becomes detrimental to any adjacent lots, roads or general appearance of the cemetery grounds.
22. The Linn Public Cemetery Association requires that when possible, a minimum depth of 24” of earth be placed on top of the grave after a burial. Grave diggers must meet the approval of the cemetery board.
